These Terms & Conditions (“Terms”) govern all services provided by Liam Betteley (“I”, “me”, “my”) including graphic design, illustration, web design, social media management, printmaking, and related creative services. By commissioning work, purchasing products, or engaging my services, you (“Client”, “you”) agree to these Terms.

1. PAYMENT

A 50% non-refundable deposit may be required before work begins.

Full payment is required prior to delivery of final files, products, or assets.

All invoices are payable within 30 days of issue. Late payment may incur interest at 8% above the Bank of England base rate plus reasonable recovery costs.

Payment plans may be agreed at my discretion in writing.

2. COPYRIGHT & OWNERSHIP

I retain all copyright and intellectual property rights in all designs, artwork, sketches, drafts, concepts, and preparatory work.

Upon full and final payment, you are granted a non-exclusive, non-transferable license to use the final deliverables for the purpose set out in the project brief.

This license does not permit resale, relicensing, or commercial exploitation beyond the agreed scope unless a separate agreement is made.

Drafts, unused concepts, and preparatory materials remain my property.

Full copyright transfer may be negotiated separately for an additional fee and must be confirmed in writing.

3. LICENSE TERMS

The license is valid perpetually unless otherwise stated in writing.

You may use the final deliverables only for the intended and agreed purpose (branding, print, digital use, social media, etc.).

Unauthorized use outside the agreed license constitutes copyright infringement and may result in legal action.

4. FONTS & THIRD-PARTY ASSETS

Fonts, stock imagery, plugins, and other third-party assets are subject to their own licensing terms.

If editable or reusable rights are required, you must purchase your own license directly.

Converting fonts into vector outlines for print is permitted, but distribution of font files is not.

5. PORTFOLIO & PROMOTION

I may showcase work, process materials, and case studies in my portfolio, on social media, and in print or online publications.

Confidentiality or NDA requirements must be agreed before work begins.

6. CANCELLATION & TERMINATION

If you cancel a project after work has commenced, the deposit is non-refundable. Additional costs may be invoiced depending on work completed.

If I cancel due to illness, force majeure, or unforeseen circumstances, a pro-rata refund will be provided.

I reserve the right to suspend or terminate a project if:

Payment is not received,

Excessive micromanagement occurs,

Communication is absent for over 30 days, or

There is a breach of these Terms.

In these cases, all work remains my property and no refunds are given.

7. PRINTMAKING & PRODUCT SALES

Physical prints, artwork, and merchandise remain my intellectual property.

Purchasing a product gives you ownership of the item, not copyright or reproduction rights.

Custom commissions for physical goods are subject to these Terms.

Consumer rights under the Consumer Rights Act 2015 apply: goods must be of satisfactory quality, fit for purpose, and as described. Returns/refunds for defective items are handled accordingly.

8. TRADEMARK & BRAND NAMING

I do not provide legal advice regarding trademarks, copyrights, or brand name availability.

You are responsible for ensuring your brand, product, or company name is legally free to use.

9. DATA PROTECTION (GDPR)

Personal data collected during a project (e.g., emails, payment info) will be used solely to provide the agreed services.

Data will be processed and stored in compliance with UK GDPR.

You may request access to or deletion of your data by contacting me directly.

10. LIMITATION OF LIABILITY

I take reasonable care to ensure originality but am not liable for legal disputes arising from your use of my work.

I am not liable for indirect, consequential, or incidental losses.

Services and deliverables are provided “as is” without warranties of fitness for a particular purpose.

11. FORCE MAJEURE

I am not liable for delays or failure to perform obligations due to circumstances outside my reasonable control, including natural disasters, illness, government actions, strikes, internet outages, or acts of war.

12. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

FAQ

  • All designs, artwork, sketches, and drafts remain my property until full payment is received. Even then, you are granted a license to use the final deliverables, but I retain full copyright. Drafts, unused ideas, and preparatory materials always remain my property.

  • The license you receive covers only the agreed purpose (e.g., branding, social media, print). You may not resell, redistribute, or claim authorship of my work without a separate agreement. Extended or commercial rights can be negotiated.

  • Before work begins: deposits may be refundable only at my discretion.

    After work begins: deposits are non-refundable, and additional work done may be invoiced.

    If a project is terminated, no license is granted to use any work produced to date.

  • Fonts, stock images, and other third-party assets are subject to their own licenses. You may need to purchase your own license if you want editable or reusable rights. Any converted or outlined fonts in final files can be used for print, but font files themselves cannot be distributed.

    • You own the physical item, but not the copyright.

    • You may not reproduce, scan, or resell my artwork.

    • Consumer rights under the Consumer Rights Act 2015 apply: items must be as described, of satisfactory quality, and fit for purpose.

  • You are responsible for ensuring your brand or product name is legally available. I do not provide trademark or copyright checks, so please confirm your name is safe to use before starting a project.

  • I take reasonable care to ensure originality and quality. If there are issues, I will work with you to correct them. I am not liable for indirect or consequential losses, and delays caused by circumstances beyond my control (force majeure) are not considered a breach.

  • Any personal data collected (emails, payment info) is used only for providing services and handled in compliance with UK GDPR. You may request access or deletion of your data at any time.
